Communal military systems in the Fourteenth and Fifteenth Century Italy are largely based on personal compulsory corvées. Therefore, townsfolks mobilisation for military expeditions (Cavalcate) need to be enforced by some sort of sanction, of a nature and severity varying from Commune to Commune and according to circumstances. In Siena, thanks to thanks to extensive documentation, it can be observed how the Commune punished transgressors between XIII and 1287 with the Ghibelline government and from 1287 to 1355, the years of the Guelph government of the Nove. From the analysis of the documents, it is possible to measure the political meaning of the offense, treated differently by Ghibellini and Guelphs, the economic impact that the fines had for offenders. It was with the government of the Nove that the first military justice organs were created, functional to the policies of the regime. With the crisis of the government of the Nine, we are witnessing a slow but progressive decrease in the offense towards the middle of the fourteenth century, attributable to the increasingly important use of mercenary troops.
